Amazon can use the term App Store

As if the war of patents is not enough, now the major tech companies are battling it for some tech terminology.

Does Apple have a copyright over the term App Store? The company thinks it does. That is why Apple went to court in March this year to prevent Amazon from using the term App Store to refer to its Android marketplace. Well, the U.S. District Court Judge Phyllis Hamilton has decided that the term App Store is descriptive. Hence Amazon can use it for its online marketplace for Android apps.

However, the litigation over this issue is far from over, as the judge has written in his order that that while Apple did have substantially exclusive use of the phrase initially, the term appears to have been used more widely by other companies as time has passed. Hence the inference can be made that the order is for a particular instance and a broader view of the subject is yet to taken.

The legal scuffle showcases the intensifying rivalry between tech companies for cornering the lucrative mobile computing market. Apple and Amazon compete in the online market for such content as e-books and digital music. There you go folks. Looks like there is going to be more legal fireworks between Amazon and Apple over App Store.
